Following on from my previous articles below about the Pilot for Transparency and Court Reporting in Family law matters:; see below, there have been 2 further significant developments.
The Transparency Pilot – A Relaxation of Rights to Privacy in Family Proceedings February 2023 and
The Family Court’s Transparency Pilot Scheme: One Year On and the Introduction of a Similar Pilot for Financial Remedy Proceedings January 2024, a couple of further stages of the Pilot Scheme are proceeding.
- As of Friday, 8 November 2024 public and private children law cases before Magistrates in all 19 pilot areas will be included in the scheme. The 19 Courts which are in the Public and Private Children Transparency Pilot (as of 11.11.24).
https://www.judiciary.uk/extensions-to-family-court-transparency-pilots/ - From today, 11 November 2024, the pilot for reporting financial remedy proceedings will extend to the Royal Courts of Justice. This follows on from the previous pilots for reporting financial remedy proceedings in the Central family Courts in Leeds and Birmingham which commenced in January 2024.
This move towards greater transparency in family courts, particularly in financial remedy proceedings, has caused division amongst family law professionals. However, the overriding direction of travel need is that the need to inspire public confidence in the family Court System outweighs those concerns.
For couples going through divorce this move towards transparency will potentially be one further reason for favouring non-court resolution NCDR – a private means of resolving family law matters. Your family lawyer will still support you through this process, and NCDR comes in various forms to suit your preferred approach.
